MyPorta Consumer Terms
Version: consumer-terms-v1
What changed: Section 7 now says plainly that automated copying of MyPorta, and use of our data or APIs to build or feed another property service, is not allowed without our written agreement, and that search engines and AI assistants may index our public pages within our robots.txt. Nothing else has changed. Your statutory rights are preserved and no right or claim is removed retrospectively. Read the previous terms.
MyPorta is a free service for finding and researching property. It provides information and tools to help your search; it does not replace your own checks or professional advice. There is no subscription, guaranteed availability or guaranteed property-search outcome. Your legal rights remain unaffected.
1. About these terms
MyPorta is operated by AI Property Intelligence Ltd, company number 16474737, registered in England and Wales, with registered office at Suite 3 The Palace Theatre, 156 High Street, Swansea, Wales, SA1 1NE.
These terms cover personal use of our consumer website and features. Agent and partner activities are covered by separate agent terms or agreements. Please read these terms before using the service.
Our Privacy Policy explains personal-data use, and Cookies and browser choices explains optional features and storage. These notices explain our practices; using the site is not blanket consent to marketing, optional tracking or additional uses of personal data.
Contact hi@myporta.ai for general questions, or privacy@myporta.ai for privacy, rights and legal matters.
2. A free service, provided as available
Our standard consumer services are free. Using them does not create a payment obligation or automatically enrol you in a paid service. Any future paid service would require a separate, clearly presented agreement before you are charged.
Features may depend on your device, account, location, available data, suppliers or technical capacity. We do not promise continuous access, fixed support response times, a minimum period of service or that a particular feature or listing will remain available. Sections 9 and 10 explain changes and suspension. None of this excuses a failure to meet a legal obligation.
MyPorta is not your estate agent, surveyor, conveyancer, mortgage adviser or other professional adviser. Using it does not appoint us to act in a property transaction or authorise us to enter an agreement for you.
3. Property information and automated features
Listings, photographs, prices, availability, maps and neighbourhood information come from different sources and can be incomplete, incorrect or out of date. Estimates, summaries, comparisons and recommendations are for information. They are not surveys, formal valuations, mortgage offers, promises of suitability or a complete statement of everything relevant to a property.
AI features can make mistakes or produce convincing but inaccurate statements. Generated images, furniture placements and virtual staging are illustrations, not evidence of a property’s condition, dimensions, contents or achievable alterations. Check important information with the agent, relevant public records or a suitably qualified professional before making a decision.
We do not promise to show every property, find a suitable home, rank results in a particular way or obtain a viewing, response, mortgage, purchase or tenancy. A listing is not an offer by MyPorta to sell or let the property. Reporting an error does not guarantee a particular response or correction time, although legal duties still apply.
4. Accounts and saved information
You must be at least 18 to create an account. Give accurate account information, keep sign-in details secure and do not let someone else misuse your account. Tell us if you suspect unauthorised access. You are not responsible under these terms for a failure in our own security merely because it affects your account.
Where available, you can save homes and searches, manage preferences and review sharing records. Saving a home or search, or marking a search as “Planning a move”, does not by itself send an enquiry to an agent or sign you up to new marketing.
Keep your own copies of information you need. MyPorta is not a guaranteed archive or backup service. If you stop using it, your personal-data rights and the retention information in our Privacy Policy still apply.
5. Your uploads and content
You retain ownership of content you supply, subject to any existing rights held by others. You must have permission to supply it and must not upload unlawful, infringing, confidential or unnecessarily sensitive material. Avoid including other people’s personal information unless you are entitled to do so.
You give us a non-exclusive, worldwide, royalty-free licence to receive, store, copy, format, analyse and process your content as needed to provide the features you use and carry out sharing you request. This includes using contracted service providers for hosting, image processing and AI features. It does not give us ownership, permission to advertise your private uploads publicly or unrestricted rights to sell them.
Account uploads and saved information are not public by default. Service providers may nevertheless process them to operate the features you use, as explained in the Privacy Policy. Review the material and recipient before using a sharing feature.
Any use of personal data to develop or improve models must have an appropriate lawful basis and be explained in the applicable privacy information. This content licence does not replace those requirements. Processing property content obtained from agents or other licensed sources is governed by the relevant permissions.
You can request removal through available controls or privacy@myporta.ai. We handle requests under applicable law and our Privacy Policy, including lawful retention and backup exceptions. There is no separate contractual promise to erase every copy within a fixed number of days. Content already shared with another recipient may remain in that recipient’s possession.
6. Enquiries, sharing and other services
When you choose to send an enquiry or share a brief, review the named recipient and selected information before confirming. MyPorta transmits the request through its available delivery services; delivery and a response from the recipient are not guaranteed.
Where a withdrawal control is available, it can stop future access or queued delivery within MyPorta. It cannot recall delivered email or guarantee deletion by an independent recipient. Our Privacy Policy explains the available controls and their limits.
Agents and other recipients handle the information they receive under their own responsibilities and privacy information. Sending an enquiry is not blanket permission for unrelated marketing. We remain responsible for our own handling of your personal data.
Links, maps, videos, shopping tools and other integrations may involve independent providers. Their availability, charges and terms are their own. A link or listing does not make us responsible for their performance or constitute a guarantee of their suitability. These provisions do not exclude responsibility for our own acts or omissions where the law makes us responsible.
7. Acceptable use and intellectual property
Use MyPorta lawfully. Do not impersonate someone, harass others, submit fraudulent enquiries, introduce malicious code, interfere with the service, bypass access controls or access another person’s private information. Automated extraction or commercial reuse requires our permission unless the law allows it without permission.
Automated access and data extraction. MyPorta’s pages, search results, property listings, photographs, area guides, data feeds and application programming interfaces (APIs) are provided for individual home movers and for the agents who list with us. Our listings database and area guides are protected by copyright and by database right. Unless we have agreed otherwise in writing, you must not, and must not allow, assist or pay anyone else to:
- use any robot, spider, scraper, crawler, headless browser, script or other automated means to access, monitor, copy, download or extract any part of MyPorta or its data, whether in bulk or on a recurring basis;
- call our APIs or internal endpoints other than as part of a person’s ordinary use of the website or app;
- reproduce, republish, aggregate, resell, or use MyPorta data to build, train, check or supplement any database, index, listing service, valuation model, dataset or product that competes with or replicates any part of MyPorta;
- do any of the above on behalf of, or for the benefit of, a property portal, data provider, marketing service or other business.
The only exceptions are search engines and AI assistants indexing our public pages within the limits set out in our robots.txt file, and access under a written agreement with us. We may rate-limit, block or suspend any access we reasonably believe breaks these limits, and we reserve all other remedies available to us.
Our software, design and branding, and content supplied by others, remain the property of their respective rights holders. You may use available features for your personal property research. Do not republish protected material beyond the permissions provided by the feature, the rights holder or applicable law.
8. Responsibility and liability
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability the law does not allow us to exclude or limit. Your statutory consumer and data-protection rights remain unaffected.
Subject to those rights, we are not responsible for:
- loss that is not caused by our breach of a legal duty or these terms;
- loss that was not reasonably foreseeable when you used the service, meaning it was neither an obvious consequence nor something both you and we knew was likely;
- business losses arising from using the consumer service for commercial purposes, including lost profits, revenue, business opportunities or business interruption; or
- an independent third party’s actions or failures, except where the law makes us responsible for them or our own conduct contributes to the loss.
The limits of the free service described in these terms do not remove a duty or remedy that the law requires. We do not provide an additional compensation scheme, service credits, a performance guarantee or an indemnity. Liability, if any, is determined under applicable law.
9. Changes and availability
We may update features or change or discontinue all or part of the free service for reasons such as maintenance, security, legal requirements, supplier changes, technical limitations or the cost and practicality of continuing it. We will act reasonably, give any notice required by law and, where reasonably practicable, give advance notice of a material change that adversely affects existing users. No fixed notice period or minimum continuation period is promised.
We may update these terms for corresponding reasons. We will identify material changes and their effective date and obtain agreement where required. Changes do not retrospectively remove rights or claims. Merely continuing to browse is not consent to a new charge, an expanded content licence or optional personal-data processing. If you do not accept revised terms, you can stop using the affected service.
10. Suspension and leaving
You may stop using MyPorta at any time. Account controls and our privacy contact provide routes to request access, deletion or other applicable personal-data rights. Deleting app data and deleting a separate sign-in account may be different actions, as explained in the Privacy Policy.
We may proportionately restrict access or remove content for misuse, material breach, a rights dispute, a security risk or a legal requirement. Immediate action may be necessary. Where appropriate and lawful, we may explain the issue or offer a chance to resolve it; there is no guaranteed review or support response time beyond legal requirements. Ending access does not remove rights already accrued or ongoing legal obligations.
11. Law and disputes
The law of England and Wales governs these terms. If you live elsewhere, this does not deprive you of mandatory consumer protections that apply where you live. You may bring proceedings in any court available to you under applicable law, including your local courts where you have that right. We will bring proceedings only in a court permitted by that law.
You can contact hi@myporta.ai or privacy@myporta.ai about a concern. There is no contractual complaint-resolution deadline, compulsory arbitration, required paid mediation or requirement to contact us before exercising a legal right. Any statutory complaint or response duties still apply.
12. Other provisions
If a provision is unenforceable, it does not bind you to that extent; the remaining provisions apply where they can lawfully operate. A delay in enforcing a term is not a waiver.
We may transfer the service or this agreement as part of a genuine business transfer if the successor assumes our obligations and the transfer does not reduce your legal rights. Any notice required by law will be provided. These terms do not override a separate expressly agreed arrangement or an assurance that the law makes binding on us.
